GENERAL TERMS
1. All federal, state, and local firearms laws and regulations will be observed.
2. All bidders must be legally eligible to purchase firearms under applicable federal, state, and local laws.
3. Valid government-issued photo ID required for registration.
4. Federal Firearms License (FFL) holders must provide current copy of license prior to bidding.
BIDDER REGISTRATION
1.All bidders must register and receive a bidder number prior to bidding.
2.Only the Registered Bidder may transfer and take ownership of firearms.
3.You Must be 18 years of age to bid on and buy long gins and must be 21 years of age to bid on and buy handguns.
2. Registration requires:
- Valid government-issued photo ID
- Current phone number and address
- Signed agreement to these terms and conditions
3. The auction house reserves the right to refuse registration to any person.
PAYMENT TERMS
1. Payment in full required day of sale.
2. Accepted payment methods:
- Cash
- Credit Card (3% processing fee)
- Debit Card
- Certified Funds
3. Personal checks accepted ONLY from known customers or with bank letter of guarantee.
4. A buyer's premium of 15% will be added to all successful bids.
5. All applicable taxes will be collected.
FIREARMS TRANSFER AND PICKUP
1.ONLY THE WINNING BIDDER may transfer or take possession of firearms won at auction. NO EXCEPTIONS.
2.ALL transfers must occur at 5 South Main Street, Carthage, IN 46115.
3.Firearms transfers cannot be redirected to other parties or locations.
4.As licensed FFL dealers, we will conduct all required background checks at NO COST to buyers.
5.Background checks will ONLY be conducted after payment in full is received.
6.The winning bidder must:
oComplete payment in full
oComplete ATF Form 4473 in person at our Carthage location
oPass required background checks
oShow same ID used for registration
oComply with all waiting periods
7.For FFL Dealers who are winning bidders:
oMust provide current copy of FFL for transfers
oMust complete transfer in person at our Carthage location
FAILED TRANSFERS AND FORFEITURE
1.If winning bidder cannot take possession for ANY reason:
oNo refunds will be issued
oPayment is forfeited
oFirearm will be automatically consigned to next auction
oOriginal buyer is responsible for:
15% Commission
$5.00 Lot Fee
$30.00 Restocking Fee
2.Any attempt to transfer firearms to someone other than the winning bidder or at another location will result in:
oImmediate cancellation of sale
oForfeiture of payment
oBan from future auctions
INSPECTION AND WARRANTY
1. All items are sold "AS IS, WHERE IS" with no warranties expressed or implied.
2. Bidders are responsible for inspection prior to bidding.
3. All sales are final - no returns or refunds.
4. Descriptions are provided as a courtesy only and do not constitute a warranty.
SHIPPING
SHIPPING OF FIREARMS: All firearms must be shipped to an FFL (Federal firearm Licensee) of the buyer's choosing, FFLs are fairly easy to find (most gun shops will do this for you), and most charge a nominal fee for this service. A shipping and handling fee will be assessed to the buyer. The receiving FFL will then perform the transfer of the firearm to the buyer including any required background checks, the buyer is responsible for any fees assessed by his/her FFL.
An adult signature will be required for the receipt of any firearm that is shipped. You will need to contact your FFL dealer and have them send a copy of their FFL to shipping.burgessauctionsllc@gmail.com and include your name in order to complete the shipping of your winning firearms.
1. No direct firearm shipping to buyers.
2. All firearms must be shipped to a licensed FFL dealer.
3. Shipping costs and arrangements are buyer's responsibility.
4. Insurance and adult signaturerequired on all shipments.
LIABILITY
1. Bidders assume all risks of injury or loss during the auction.
2. The auction house is not responsible for accidents or losses.
3. Bidders agree to indemnify and hold harmless the auction house from any claims.
AUCTION CONDUCT
1. The auctioneer reserves the right to:
- Reject any bid
- Resolve bidding disputes
- Withdraw any item
- Group or divide lots
2. The auctioneer's decision is final in all matters.
ADDITIONAL TERMS
1. Catalog errors will be corrected as discovered.
2. Items must be removed within 7 days of sale.
3. Storage fees apply after 7 days.
4. Failure to comply with terms may result in:
- Sale cancellation
- Loss of bidding privileges
- Legal action
